Bataille judiciaire autour du couvre-feu aux Pays-Bas — Covid

Un tribunal de La Haye a statué: le gouvernement néerlandais doit mettre immédiatement fin au couvre-feu en vigueur.

L'Etat entendait en effet que le couvre-feu reste d'application au moins jusqu'à ce que l'affaire ait été examinée sur le fond en appel. Cette mesure de lutte contre le covid-19 ne justifierait pas un caractère d'urgence. "Les juges, saisis par le collectif " Viruswaarheid " (" la vérité sur le virus "), ont estimé que cette mesure constituait une "violation profonde " de la liberté de mouvement et de la vie privée et qu'elle nécessitait "un processus décisionnel très minutieux ". L'affaire avait été portée devant la justice par un groupe protestant contre l'instauration de cette mesure, laquelle a provoqué de violentes émeutes dans le pays.

La décision, tombée ce mardi en fin de journée, est un sérieux revers pour les opposants au couvre-feu instauré aux Pays-Bas.

Début février, les autorités néerlandaises ont annoncé prolonger jusqu'au 2 mars, le couvre-feu national de 21 heures à 4 heures 30.

Or, un juge de première instance a statué que "l'introduction du couvre-feu n'impliquait pas l'urgence particulière requise" pour pouvoir utiliser cette loi, notamment parce que la possibilité d'une telle mesure a été discutée à de nombreuses reprises avant sa mise en vigueur, selon le tribunal.

Le gouvernement n'a pas immédiatement réagi à ce jugement. Un porte-parole du tribunal a fait savoir à l'AFP que si toutefois il y avait appel de la décision, celui-ci ne serait pas suspensif.
