The mother of Kenosha gunman Kyle Rittenhouse was given a "standing ovation" at a GOP event in Wisconsin as her son fights extradition to the state where he is charged with shooting dead two protesters. Novak granted Pierce two weeks to prepare his arguments challenging Rittenhouse's extradition and gave the defense 14 days to review papers and file pleadings before the next hearing scheduled on October 9, 2020.
'We intend to challenge extradition by writ of habeas corpus, ' Pierce said.
Kyle Rittenhouse, 17, is charged with shooting and killing two protesters and injuring a third on the streets of Kenosha on August 25 (right). The lawyer said he hadn't received a copy of a Wisconsin arrest warrant for his client.
Linda Watson, chairwoman of the Illinois State Bar Association's criminal justice section, said the chances of Rittenhouse avoiding an eventual extradition to Wisconsin are slim.
The only possible arguments against extradition are, "You got the wrong guy" or "That's not a crime, '" Watson told NBC News on Friday.
Since the identity question appears to have been resolved, Rittenhouse is expected to be extradited, Chicago attorney Stephen Komie told the Chicago Tribune.
During the remote hearing Friday, Rittenhouse appeared on camera in a box on the lower right-hand side of the screen as he sat in front of a bare, cinder block wall. He wore a blue face mask and a black sweatshirt.
Pierce also requested that he be allowed to bring a laptop into the juvenile detention facility in Vernon Hills where Rittenhouse is being held, despite a ban on electronic equipment, so they could review video evidence together from the night of the shootings.
"There is, as you probably know, there's an vast amount of video evidence, and we really do need to be able to review that along with our client", Pierce said.
His attorneys have said Rittenhouse acted in self-defense and have portrayed him as a courageous patriot who was exercising his right to bear arms during unrest over the shooting of Blake, who is Black. The delay in returning Rittenhouse to Wisconsin is the second in the case. "I was able to talk to Kyle by phone & THANK HIM for his courage!"
Rittenhouse's legal team includes Los Angeles-based Pierce and Lin Wood, a defamation lawyer who represented falsely accused security guard Richard Jewell in the 1996 Olympic Park bombing case in Atlanta and is a lawyer for Sean Hannity, the Fox News host with close ties to President Donald Trump.
"I guess it looks like and he fell and then they very violently attacked him and it was something we're looking at right now and it's under investigation", Trump said days after the fatal encounter. He probably would have been killed.
