Police are still mulling over possible felony child endangerment charges for Sanders.
Authorities responding to a report of a man passed out behind the wheel of a running auto say they found Zachary Frey, 26, "nodding off" in the parking lot of a Chillicothe Burger King with a bag of what they believed to be heroin in his pocket, reports the Chillicothe Gazette.
The woman, identified by police as 26-year-old Elizabeth D. Sanders, allegedly wandered into the bathroom of the fast food restaurant and reportedly gave birth to her son in one of the stalls, according to The Chillicothe Gazette.
"Due to her level of impairment she was completely unaware, or at least believed to be unaware, that she was giving birth at the time", Chillicothe Police told the station.
Officers found Sanders seated on the toilet inside a bloodied stall, with a suspected ball of heroin on the floor nearby and the baby floating face-up in the toilet, police said.
A medic who responded to the call looked inside the toilet and found the baby who was face-up.
The baby boy, who survived, was rushed to the hospital for treatment.
Police and fire responded to the scene and found 26-year-old Zachary Frey passed out behind the wheel of a running vehicle in the parking lot.
Sanders was treated at the Adena Medical Center and was arrested upon her release on a previous warrant for alleged theft of money from a bartending job, according to the newspaper.
Frey was charged with operating a vehicle while impaired and possession of drug paraphernalia.
