Faced with a barrage of criticisms, Justice Secretary Vitaliano N. Aguirre II ordered the National Bureau of Investigation (NBI) on Wednesday to investigate for possible irregularities the government prosecutors behind the dismissal of the drug case lodged against Cebu businessman Peter Lim, self-confessed drug lord Kerwin Espinosa and several others.
"Indeed, for an evidence to be believed, it must proceed not only from the mouth of a credible witness, but must be credible in itself as to hurdle the test of conformity with the knowledgeable and common experience of mankind", read the resolution approved by Senior Deputy State Prosecutor Rassenell Rex Gingoyon and Acting Prosecutor General Jorge Catalan Jr.
In the complaint, the CIDG-MCIU charged the respondents with trading and distribution of risky drugs, which is punishable by life imprisonment under Section 5 of Republic Act 9165 or the Comprehensive unsafe Drugs Act.
However, the prosecutors said Adorco's testimonies were "rife with inconsistencies and contradictions", casting doubts on their truthfulness. "His contradictory statements on important details simply eroded the integrity and veracity of his testimony", it added.
The police said Espinosa conspired with several drug couriers and shabu suppliers Lim, Peter Co, and Lovely Impal, to sell and distribute drugs from Makati City to selected areas in the Central and Eastern Visayas regions.
FORMER Cebu City mayor Michael Rama is hopeful that his name will be removed soon from a list of alleged drug protectors named by President Rodrigo Duterte almost two years ago. Supposedly members of the Chinese triad, Co was operating in Metro Manila and Luzon, while Lim in the Visayas.
The DOJ Task Force on Illegal Drugs has dismissed the drug charges filed against Lim and at least seven others for failure of the CIDG to present sufficient evidence against the respondents.
Senators have criticized the Justice Department for its prosecutors' decision, noting that Espinosa himself had admitted involvement in the drug trade.
Kerwin Espinosa is a self-confessed drug dealer who revealed his suppliers at a Senate hearing in 2016. She has been detained without bail at the Philippine National Police Custodial Center in Camp Crame since February 2017 over drug charges.
Espinosa has been held by authorities since November 2016 when he was arrested in Abu Dhabi over drug trafficking charges, and brought back to the Philippines.
