The Oyo State government had set up the commission on May 19, 2017, to review the declaration, after which a report was submitted to Governor Abiola Ajimobi in August 2017.
It is an open secret that the fortunes of APC has nosedived in the state due to Governor Ajimobi's undue arrogance, grandstanding, nepotism, caustic and unguarded utterances and creating unnecessary divisions among party leaders and members thereby balkanising the party along group lines.
But the Osi Olubadan of Ibadan land, Rashidi Ladoja, challenged the composition and recommendations of the commission in court, joining Ajimobi as co-defendant.
In her first judgment, Justice Olajumoke Aiki held that wearing of beaded crowns is an exercise which is beyond the purview of Sections 10,12 and 25 of the Oyo State Chiefs Law, stating that Section 25 of the Chiefs Law could not be treated in isolation to the provisions of Parts Two and Three of the Chiefs Laws of the State.
" The procedures of part 2 and 3 of the Oyo State Chiefs Law under Sections 10,12 and 25 do not empower the governor to set up any commission of inquiry to review the 1957 Ibadan Chieftaincy Declaration".
Aiki also said that the governor can not delegate power on what he does not possess.
Meanwhile, Ladoja has praised the verdict, describing it as a victory for Ibadanland.
"I requested for his kind intervention to see to the success of the project which to all intents and purposes would not only assist examination candidates in my hometown but would also be a boost to our party".
Counsel for Ajimobi, Nurudeen Adegboye, said the team would apply for a copy of the judgment and study it.
Adeboye said, "The judge has invested a lot of efforts, energy and precious time on the judgment". We will look at it again and (act) based on the instruction of our client because it is our client that has the right to appeal or not.
He jointly filed the initial suit with his immediate senior on the Otun Olubadan chieftaincy line, Oba Lekan Balogun, but Balogun later backed out of the cases, claiming that he had earlier misunderstood the intention of the governor.
The governor made the assertion at the inauguration of a block of classrooms donated by Chief Akin Olujimi (SAN) to Community Secondary School, Ajara in Ibadan. Let me reiterate here that the review was an exercise that was well thought out.
The commission recommended the review of the Olubadan chieftaincy system.
"The truth is that people are normally opposed to change and radical policies that will eventually be beneficial to them, but we shall get there".
The Minister of Communication, Adebayo Shittu has reported the Oyo State Governor, Abiola Ajimobi, to President Muhammadu Buhari, the national national chairman of the All Progressives Congress, APC, John Odegie-Oyegun and a national leader of the party, Bolaji Ahmed Tinubu.
